위임장 (Power of Attorney)

How does a Power of Attorney work? 
A Power of Attorney is used to confer your rights to make decision to another person. It is a legally binding document and can take form in (i) short-term or (ii) long-term. 

Before getting into brief details of the document, it should be noted that the person called “attorney” in this case does not mean a lawyer.  A person who receives another person’s decision-making powers is called an “attorney” and this person must be 18 years of age or older.  The person can be a member of your family or a close friend. ​​​

A short-term Power of Attorney may be used in any transaction where you will be absent when a decision must be made. For example, if you expect to be absent when a real estate transaction closes, you may transfer your rights to sign for all necessary documents and register any deeds to another person in your absence. Please note that such short-term Power of Attorney is time-limited and may be cancelled at any time. Some financial institutions and real estate agents may have a form prepared for this purpose.

There are two types of a long-term Power of Attorney: (i) Power of Attorney for Personal Care and (ii) Power of Attorney for Property. They are both used in a case where you have become mentally incapable of making decisions for yourself. You may wish to cancel such Power of Attorney; however, you will be required to prove mental capacity through the Office of the Public Guardian and Trustee.

(i) Power of Attorney for Personal Care is used when you have become mentally incapable of making decisions regarding medical or long-term care of yourself. You may designate a close friend or a family member; however, you may not designate a person who would be paid to take care of you in any case, such as a nurse, caregiver, social service worker, or a physician. At the same time, you may consider preparing an advance directive containing your wishes regarding medical or long-term care (e.g., no life support) making it easier for your attorney to make difficult decisions on your behalf.

(ii) Power of Attorney for Property is used when you have become mentally incapable of making decisions regarding your financial matters. These may include paying bills, maintaining or selling your home, and investments. You must ensure that your attorney fully understands your wishes in regard to financial matters and your attorney must make detailed record of all transactions related to your financial matters. If you cannot find a suitable attorney to act on your behalf, there is an option of using a trust company, which will incur some costs. 

A Power of Attorney must be signed in front of two (2) witnesses. Your spouse or your child cannot be one of the witnesses. Ensure that the Power of Attorney is kept in a safe place and notify all others (including financial institutions) about the existence of and the location of the Power of Attorney.

위임장(Power of Attorney)은 자신의 권리를 타인에게 위임할 때 사용하는 것으로, 법적인 효력을 갖는 매우 중요한 문서입니다. 이번 칼럼에서는 이 위임장에 대해서 ‘단기 위임장’과 ‘장기/영구 위임장’으로 구분해서 소개해드리도록 하겠습니다.​

​먼저, ‘단기 위임장’은 본인이 부재중인 경우에 금융거래나 부동산 거래 등을 할 때 사용하는 것으로, 명확한 위임기간 동안에 한시적으로 자신의 의사결정 권리를 수임자(Attorney)에게 위임하는 것입니다. 예컨대, 해외에 장기체류를 하면서 국내 금융거래를 해야 하는 경우에 사용할 수 있는데, 단기 위임장의 경우에는 위임 기간 중에도 언제든지 위임을 취소할 수 있습니다. 금융거래에 관한 단기 위임장일 경우 각 은행기관에 준비된 form을 사용하셔도 무방하겠습니다.

다음으로 ‘장기/영구 위임장’에는 2가지 종류가 있는데, ‘개인 건강에 대한 위임장 (Power of Attorney for Personal Care)’과 ‘개인 재산에 대한 위임장 (Power of Attorney for Property)’이 그것으로, 이 위임장들은 본인이 스스로 결정할 수 있는 정신적인 능력이 상실될 경우를 위한 것입니다. 그리고 이러한 위임장들은 도중에 취소를 하려면 본인에게 정신적인 능력이 있음을 증명해야 합니다 (정신 능력 평가는 Office of the Public Guardian and Trustee에 연락하여 진단 받을 수 있습니다).

이러한 장기/영구 위임장에 대해 좀 더 자세히 소개해 드리자면, ‘개인 건강에 대한 위임장 (Power of Attorney for Personal Care)’은 본인 스스로 결정할 수 있는 정신능력이 상실 되었을 때 대신 결정을 할 수 있도록 개인의 의료 또는 장기 요양 (medical or long-term care)에 대한 결정권을 18세 이상의 성인 수임자에게 위임하는 것 입니다. 이때 18세 이상의 성인이 친구일 수 있고 가족 중 한 명 일 수 있지만 간병인과 같이 보수를 받는 사람, 복지사, 의사/간호사와 같은 의료인에게 위임할 수는 없습니다. 이 위임장을 작성한 후에는 ‘사전의료지시서(advance directive)’를 작성해서 의료 또는 장기 요양 사항에 대한 (예컨대, 더 이상 회복 가능성이 없을 때 생명 유지 장치 불사용 등) 본인의 의사를 수임자에게 미리 전달하여 어려운 결정에 대한 본인의 확고한 의사를 인지하게 하는 것을 추천합니다.

‘개인 재산에 대한 위임장 (Power of Attorney for Property)’은 개인의 재무 관련 사항에 대해서 대신 결정할 수 있도록 결정권을 타인에게 위임하는 것 입니다. 재무 관련 사항이라고 하면 고지서 납부, 집 관리 또는 매매, 투자 처분 등이 해당됩니다. 본인의 정신적 능력이 상실 되었을 때 대신 결정할 사람을 미리 지정하는 것으로 반드시 재무와 관련된 본인의 의사를 충분히 이해시켜야 하며 지정 받은 수임자는 재무와 관련된 모든 업무에 대해서 상세한 기록을 남겨야 합니다. 재무와 관련해서 주변에 신뢰할 사람이 없는 경우에는 신탁회사 (trust company)에 업무를 맡기는 방법도 있습니다.

위임장에는 반드시 본인 서명과 2명의 증인 서명이 있어야 하는데 본인의 배우자 또는 자녀는 증인으로 허용되지 않으며, 위임장을 작성한 후에는 안전한 곳에 보관하시고, 수임자와 은행 그리고 그 외 위임장의 존재에 대하여 알 필요가 있는 곳에 사본을 전달하거나 위임장 보관장소를 통보하는 것이 좋습니다.
